The administrator of your personal data is Elitmind sp. z o.o. with its registered office in Warsaw, ul. Grzybowska 87, 00-844 Warsaw (hereinafter referred to as the Administrator). 2. Personal data will be processed for the following purposes: 1) For participation in the recruitment process, which includes: assessment of education, assessment of professional qualifications, including the OPQ professional personality test, and assessment of professional experience. Based on: Article 6(1)(b) of the GDPR to the extent that the data is necessary to conclude a contract; Article 6(1)(c) of the GDPR to the extent that providing data for purposes related to the pursuit of concluding an employment contract is required by the Labor Code; Article 6(1)(a) of the GDPR to the extent that the Administrator processes ordinary data voluntarily provided by the candidate beyond what is required by the Labor Code or is not necessary to conclude a cooperation agreement; Article 9(2)(a) of the GDPR to the extent that the Administrator processes sensitive data provided on the candidate's initiative beyond what is required by the Labor Code or is not necessary to conclude a cooperation agreement; Article 9(2)(b) of the GDPR to the extent that the Administrator processes health data in connection with the need to refer the candidate for preliminary examinations and obtain a medical certificate stating no contraindications to work in a specific position; Article 6(1)(f) of the GDPR for the assessment of professional qualifications in the form of OPQ professional personality tests, which constitutes the Administrator's legitimate interest; 2) For participation in future recruitments in connection with the expressed consent to process data in future recruitments (Article 6(1)(a) of the GDPR); 3) For the purpose of pursuing claims and defending against claims, which constitutes the Administrator's legitimate interest (Article 6(1)(f) of the GDPR). 4. We primarily obtain your data directly from you in connection with the recruitment process we conduct, but it may happen that we receive your data from our employees as part of the referral program. In such a case, we receive the data contained in your CV, i.e., in particular: first name(s) and surname, date of birth, contact details indicated by the candidate, education, professional qualifications, previous employment history, and other personal data indicated in the CV on your initiative. 5. Your data will be stored: 1) For the duration of the recruitment process, unless the candidate withdraws from the ongoing recruitment, and then for 3 years in connection with the possibility of establishing, pursuing, or defending claims; 2) In the case of consent to future recruitments, until the consent for participation in future recruitment processes is withdrawn, but no longer than two years from the end of the calendar year in which the consent was given. 6. Personal data may be transferred to other entities, so-called recipients of personal data, in particular: 1) Entities conducting postal or courier activities, 2) Banks for the purpose of making necessary settlements, 3) State authorities or other entities authorized by law to perform the Administrator's obligations, 4) Entities processing personal data on behalf of the Administrator, including entities providing legal or data protection services, 5) Accounting, tax, or advisory services - the transfer takes place only if there is a legal basis for it, 6) Companies providing us with IT support services, 7) Companies supporting us in the recruitment of employees, 8) The company providing SHL Polska professional personality tests. 7. Personal data may be transferred to third countries, provided that this is done in accordance with the GDPR, generally on the condition that the European Commission has determined an adequate level of data protection in the given country. In particular, data may be transferred to the United States of America based on so-called standard contractual clauses in connection with the use of IT systems provided by entities based there. Information on the applied safeguards in the case of data transfer to a third country and a copy of these safeguards can be obtained at the above-mentioned email address gdpr@elitmind.com. 8. Persons whose data is processed have the right to access their personal data and to rectify it. Additionally, in cases provided by law, they also have the right to delete data, restrict its processing, the right to data portability, and the right to object. If the processing is based on consent, they have the right to withdraw it, which does not affect the lawfulness of the data processing before its withdrawal. 9. Persons whose data is processed have the right to lodge a complaint with the President of the Personal Data Protection Office. 10. Providing personal data to the extent required by law is necessary to participate in the recruitment and conclude an employment contract, and in other respects, it is entirely voluntary. 11. The Administrator does not make decisions in an automated manner, including profiling, as referred to in Article 22(1) of the GDPR. If you include data in your application documents that go beyond the scope necessary for the recruitment process (including beyond what is required by the Labor Code), by submitting your application documents, you agree to the processing of your additional personal data contained in the recruitment application by Elitmind sp. z o.o. You can withdraw your consent at any time.
